Highly Skilled Workers – Introduction

Welcome to our Highly Skilled Workers Video Presentation, and we’re delighted that you found us. US Immigration has created a number of visa and green card options for skilled workers and graduate professionals.  The higher your qualifications are the faster and greater your chances will be of reaching your immigration goal.

In this presentation we’re going to reference a number of immigration visa options by their official name. For example, the H-1B, L-1A and so forth. We have presentations on all of these visas, so please do not hesitate to review our presentations to obtain a deeper understanding as to how each of these visas may work for you.

Most of clients are naturally very eager to obtain a green card so that they can settle permanently in the US.  However, the reality is that most aliens who are not being sponsored by a US citizen family member, must first apply for a work-based visa that will ultimately lead towards a green card in the future. There are many visas to choose from but the most common ones are the following: –

O-1A or O1-B for Aliens of Extraordinary Ability

L-1A or L-1B for Intra Company Transferees To EB2 or EB3 Green Card

H-1B Skilled Worker / Graduate Visa To EB2 or EB3 Green Card

1-Year Optional Practical Training Work Permit After Graduation from a US College

Any one of these visas can lead towards the following types of green card: –

EB1-1 or EB1-2 Green Cards For Aliens of Extraordinary Ability

EB1-3 For Intra-Company Transferees

Typically, aliens who have had an O-1A or O-1B visa will qualify for an EB1 green card. Indeed many of our clients will skip the O-1 visa altogether and go directly for a green card. This is possible because the EB1-1 in particular does not require an employer to sponsor the applicant. The EB1-3 green card is for L-1A Intra Company Transferees. However, an L-1B and H-1B visa holder may be able to qualify for the EB2 green card (Masters Degree or equivalent), or the EB3 green card (Two-Years Skilled Education or BA Degree or equivalent).

Green cards, with the exception of the EB1-1, will not only need to be sponsored by an employer, but the process can take a number of years to complete. Therefore, you can appreciate why being able to start off your immigration journey on one of the temporary work visas is essential. For example, a H-1B can last up to six years and thus give you plenty of time for you and your employer to go through the process of applying for a green card.
