Part 7 – Form DS-160 Guide – E Visa: Business Introduction

Welcome to Part 7 in this series of our DS-160 Guide

The E visa section can be the most challenging on the DS-160 form to complete, because it requires a lot of detailed, factual information about your business. Whilst this may be daunting at first, in my opinion, completing this form has a very important practical benefit for the investor, in that it’s really important for the investor to become familiar with the financials of the business. Many investors skim over the financials of the business and do themselves a disservice. The DS-160 brings the investor back to take a very close look at the financial aspects of the business.

The above having been said – with this guide you will be able to get a good thorough preview of what questions are covered in the E2 visa section of the DS-160 form.  As you review this section remember, whenever you are unsure about a particular issue, you should have the expertise of two key advisors to draw from: –

• A Certified Public Account (CPA)
• A Licensed Business Broker

CPAs and Brokers are specialists in crunching numbers pertaining to your business and thus it’s extremely important to go over the financials of your business with them. This guide, with the support of your CPA and Broker will help you insert the right financial information required to complete this portion of the DS-160.

If you’re setting up a business from scratch, then you won’t have or need a Broker to assist you.  However, you will certainly require the guidance of your CPA.

As your Immigration lawyers we cannot advise any of our clients in terms of directing them as to what financial information to enter in this portion of the DS-160. This is because the issues pertinent to this portion are commercial and financial in nature, which are outside the scope of our expertise and representation. Therefore, once you have reviewed this section please do not hesitate to share this guide with your CPA and/or Business Broker so they can interpret what information is required and extrapolate it from your business documentation.

There are in fact two forms that need to be completed when dealing with the financials of your business, the online DS-160 and the hard copy DS-156E. We’ve created guides for both forms. It may be an idea to review these guides and complete these forms together.

• Completed Business Plan
• Year to Date and Previous Business Tax Returns (if already established)
• Year to Date Profit and Loss Report or
• Set up Costs Statement
• Incorporation Documentation –
  • Articles of Incorporation, Operating Agreement and Share Certificates
