Getting a Green Card – How Long Does It Take?

Looking at the chart, you’ll find columns stating the situation of some specific countries, as well as the situation of the rest of the world. Where the column shows “C,” there is no backlog. These Green Cards will be issued as soon as they can be processed.

Let’s take India’s situation as an example. If you’re an Indian citizen applying for an EB-1 visa who starts the process today, you’re looking at a potentially three-year wait.

India has a substantial backlog for EB-2 and EB-3 visas, too. In this case, your Priority Date will come in handy. Your Priority Date is essentially your place in line for a Green Card. The current Visa Bulletin shows which Priority Dates are now being processed. So, if your Priority Date falls before the listed date, you can move forward. If your date comes after, you’ll need to wait until your turn comes up.

If you’re Indian with an approved EB-2 or EB-3 visa with a Priority Date earlier than February 2022, you may file for an EB-1 visa. This way, your case will be ushered to the front of the queue when it comes to issuing your Green Card.

If your Priority Date is later than February 2022, you will have to wait. Finally, if your spouse already has a Priority Date, and you have just filed for your EB-1, we can transfer your spouse’s Priority Date to your case. That could get you to the front of the line, too.
