L-1A Spouse’s Right to Work

By a statute enacted on January 16th, 2002, the accompanying L2 spouse must be given work authorization.  If the spouse wishes to seek employment in the US, they must first file an application for employment. USCIS will then have 90 days to make a decision on the application.  If there is an administrative backlog and a decision is not made within the prescribed period the applicant can apply for an interim employment authorization document and this document will be valid for up to 240 days.

Duration of Employment Authorization:

The spouse’s employment authorization permit will be valid for the duration of the L1 visa, but not to exceed two years.   This limitation will result in several renewals so it will be important to ensure that all renewals are filed in a timely manner.

Nature of Work Permitted:

The spouse will be given an “open market ” employment authorization. This means that the spouse can accept any type of employment presumably even self-employment.
