Discover Your Perfect Family Immigration Path
The U.S. immigration system offers multiple distinct avenues for family reunification, but selecting the correct one is vital to avoiding lengthy processing delays, costly financial mistakes, or unexpected application denials. Our comprehensive, in-depth video series and written resources walk you step-by-step through the entire legal process.
Understanding the Form I-130 Petition for Alien Relative
For the vast majority of family-based immigration cases, the entire journey begins with a single foundational document. Whether you are preparing to file an official Form I-130 Family Sponsorship petition with U.S. Citizenship and Immigration Services (USCIS) or navigating complex consular processing at a U.S. Embassy abroad, our educational resources ensure you will gain the knowledge and confidence to make highly informed decisions.
The Form I-130 establishes the qualifying relationship between a U.S. citizen or Lawful Permanent Resident (Green Card holder) and their foreign relative. However, how quickly that petition moves forward depends entirely on how the government categorizes your specific family relationship.
Immediate Relatives vs. Family Preference Categories
U.S. immigration law strictly divides family sponsorship into two main groups: Immediate Relatives and Family Preference categories.
-
Immediate Relatives: This category includes the spouses, unmarried children (under 21), and parents of adult U.S. citizens. The massive advantage here is that there are no annual numerical visa caps for immediate relatives. This means that as soon as the I-130 is approved, a visa number is immediately available.
-
Family Preference Categories: This group includes the spouses and children of Green Card holders, as well as the adult or married children and siblings of U.S. citizens. These categories are subject to strict annual limits. Because demand heavily exceeds supply, applicants often face significant wait times based on the Wait Times/Visa Bulletin.
Navigating K-1 Fiancé(e) Visas and Spousal Sponsorship
If you are a U.S. citizen planning to marry a foreign national, you generally have two primary options to bring your partner to the United States:
The K-1 Fiancé(e) Visa
The K-1 non-immigrant visa allows your foreign fiancé(e) to legally travel to the United States with the strict intention of marrying you within 90 days of their arrival. Once the marriage takes place, your new spouse can immediately apply for an Adjustment of Status to obtain their permanent Green Card without having to leave the country.
CR-1 and IR-1 Spousal Visas
If you are already legally married, you will pursue a spousal immigrant visa (CR-1 for marriages under two years, or IR-1 for marriages over two years). This requires your spouse to go through consular processing at the U.S. Department of State in their home country. Upon approval and entry into the U.S., they are immediately granted permanent resident status.
Consular Processing vs. Adjustment of Status
Understanding where your family member will process their paperwork is crucial. If your relative is already lawfully present in the United States on a different temporary visa (like a student or tourist visa), they may be eligible for an “Adjustment of Status.” This allows them to seamlessly transition to a Green Card without returning to their home country.
Conversely, if your relative is currently living abroad, they must go through “Consular Processing,” which involves attending a formal immigration interview at their local U.S. Embassy or Consulate.
