Video Transcript – Part 2 Intra-Company Transfer L-1A and L-1B Visas

Welcome to the Law Offices of Chris M. Ingram! We’re so glad to have you join us for Part 2 of our video series on Intra-Company Transfer Visas—specifically, the L-1A and L-1B visas.

In this session, we’ll walk you through how to determine whether a candidate qualifies for this type of visa. Alright— Let’s start with the section of legislation that identifies who can qualify as an intra-company transferee.

Section 214(2)(c) of the Immigration and Nationality Act states:

“…An alien who, within three years preceding the time of his application for admission into the US, has been employed continuously for one year by a firm or corporation or other legal entity or an affiliate or subsidiary thereof [the petitioning company] and who seeks to enter the US temporarily in order to continue to render his services to the same employer or a subsidiary or affiliate thereof in a capacity that is managerial, executive, or involves specialized knowledge, and the alien spouse and minor children of any such alien if accompanying him or following to join him.”

Let’s break that down into simpler terms. To qualify, a candidate must meet the following criteria:

  1. An intra-company transferee must be a manager, executive, or someone with specialized knowledge—meaning they have a specific skill set or expertise critical to the company.
  2. They must have worked for the foreign company for at least one continuous year within the last three years. This means that even if they left the company and later returned, they can still qualify—so long as they’ve completed one full year of employment within that three-year window.
  3. Their role during that qualifying year doesn’t have to be in a managerial, executive, or specialist position. The key requirement is that they were employed by the company during that period.
  4. Spouses and minor children are also eligible to obtain visas to accompany the transferee to the U.S.

Now, here’s something important to note: The terms manager, executive, and specialized knowledge have very specific legal definitions. So, in our next session, we’ll take a closer look into what it really means to be a “manager” under U.S. immigration law.
