Biden Ended the Muslim Ban on Day 1 in Office

On January 27, 2017, then-President Trump launched an attack on Muslims entering the U.S. by issuing what was to be called the ‘Muslim Ban’. The order sought to deny entry of people from Iran, Libya, Somalia, Sudan, Syria, Yemen. Nigeria was later added. After several revisions to the Muslim Ban, a weaker version was finally upheld by the U.S. Supreme Court on June 26th, 2018. In effect, people from the affected countries have been barred from obtaining any kind of visas to relocate to the U.S. except under the narrowest of circumstances.
 
Well, yesterday on President Biden’s first day in office, this Muslim Ban Executive Order and others by President Trump were revoked. As a side note, all further construction of the “the Wall” was also halted. Now all affected migrants can resume their applications. Any applicants that had been held in abeyance by USCIS due to the Muslim Ban will now be processed.
 
Based on what was signed yesterday, it is unclear whether or not the “pause” on the issuance of H-1B and L-1 visas has also been revoked. The “pause” recently extended by then-President Trump was extended until March 31st, 2021. We are currently seeking clarification on this matter and will report further asap.
 
The news so far is that President Biden will be revoking further Trump Executive orders and will be executing new Executive Orders each day, over the next 9 days.
 
A New Comprehensive Immigration Reform Bill is in the works. As soon as I can track this draft down, I’ll summarize the highlights and get that out in a newsletter asap. Biden has promised comprehensive immigration reform within his first 100-days.
 
So, right now, we’re focused on finding out whether the pause on the H-1B and L-1 visas has been lifted, as we have many clients eager to move forward on their cases. In truth, we have many more clients who have been caught up in the old Muslim Ban whose e.g., EB-1 and O-1 cases were in fact approved but their visas could not be issued because of the Muslim Ban, we are looking forward to seeing USCIS now issues their visas without any further delay.
