8 C.F.R § 204.5(h)(3)(v) – Evidence of the alien’s original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field;
Context
The beneficiary submitted expert letters discussing the significance of his original research in the field. Also submitted were citations in scholarly journals outlining his influence in the field.
AAO Discussion
1. The expert statements clearly describe how the beneficiary’s scientific contributions are original and of major significance in the field.
2. Also submitted were review articles mentioning the beneficiary’s work and documentation of numerous independent cites to his published findings. AAO states this is solid evidence that other researchers have been influenced by the beneficiary’s work.
AAO Decision
The AAO determined that review articles and citation history are solid evidence that other scientists are familiar with and influenced by the beneficiary’s work. By establishing that the beneficiary’s contributions are important to both the institutions where he has worked and the field as a whole. Additionally, leading scientists acknowledge the value of his work and its major significance in the research field. The criteria for this category has been satisfied.
