Membership

5. Membership in a professional association(s)

Membership – Here the wording simply says ‘Membership in a professional association’, but there is a lot to unpack here. Firstly, US Immigration has not stipulated whether the alien must be a member of more than one association, thus we can infer that one membership would be sufficient.  When looking at the type of membership that US Immigration would be most persuasive, we have to look at the entry criteria for admission.

There are many associations where you may simply be required to pay a membership fee. There are memberships that start with a student member level but there are progressively higher levels of membership that might, for example end in a Fellowship or Emeritus level of membership that denotes the highest honor that organization might be able to bestow on an individual.

The level of membership US Immigration would be looking for the alien to have achieved is that which would be commensurate with one having exceptional abilities in the field. Thus, for the EB2/NIW applicant the level of membership would not necessarily need to be the highest membership available as might be the case for an EB1 application where proving extraordinary ability is the goal.

Remember, overall the aim of the EB2/NIW applicant is that they have the competency to advance the National Interests of the US as outlined in part one of this series.
