In this presentation, we’re going to focus in on the O1 visa category – ‘Have you been nominated for an award or have you won a major internationally recognized award?’

The actual official wording of this category is: –  [101(a)(15)(o) and 8 CFR § Sec. 214(o)]

A) Has been nominated for or been the recipient of significant national or international awards or prizes such as an Academy Award, an Emmy, a Grammy, or a Directors Guild Award.

The first distinction we’d like to point out here is that if you are even nominated for a major award, then we can win your case on this category alone. Although the EB1 green card and the O1 visa are based on establishing that the alien has extraordinary abilities, the EB1 green card standard is significantly higher in this regard. To succeed in an EB1 green card application, the EB1’s equivalent category requires that you have to actually win the award. Nomination alone is not sufficient. Nomination alone is, however, sufficient for a successful O1 visa application.

Even though the O1 visa regulations mention specific awards such as the Academy Award, an Emmy, a Grammy or a Directors Guild Award, there are other major national and international awards that are arguably equally prestigious. For example, the Annie Awards for Excellence in Animation (40+ year history), and The Tony Awards that recognizes achievement in Broadway Productions (65+ year history). There are no doubt other major awards in fields such as radio and television, where a good claim could be made in this category.

The awards mentioned in this O1 visa category are of course US awards. However, you can qualify for an O1 visa in this category if you have been nominated or have won any award from any country where the award has national or international significance. The challenge for us would be to fully document these foreign awards, as it’s quite possible that the officer who’s reviewing your case may not have heard of a particular award.

When you have been nominated or have won a prestigious award, this proves without any doubt that you have risen to the very top of your profession. These award ceremonies exist solely to give honor and recognition to those whom, by peer review, have been acknowledged as having delivered work of the highest quality within the industry that year. Such recognition is high praise indeed.

US Immigration relies heavily upon what others in your field think of your accomplishments. Immigration cannot assess your talent themselves since the officers are not professionals in your field. For example, only a medical doctor can assess the work of another medical doctor. Therefore, Immigration will always look to see what others in the media have to say about your accomplishments in the field. Having been nominated or having won a major award from a distinguished organization is conclusive proof of your leadership standing in the field. Immigration almost has no choice but to approve your application at that point.

If you have been nominated or have won any kind of national or international award, then please contact us as soon as possible so we can make a full assessment as to your O1 visa potential. If you have never entered your work into any competition then you might want to think about how you could do this. You don’t have to win, but you might get a nomination and that could be sufficient.
