    The E2 Treaty Trader visa has been one of the corner stone visas of our practice and we’ve been able to help so many families relocate to the US because of this visa. In a nutshell, an alien can invest on average $100K into a going concern or start up business and relocate. The non-investing spouse gets a work permit and is able to seek green card sponsorship through their employer over the long term.

    The E2 Treaty Trader visa has no official end date and there are no quotas. The only problem with the E2 visa is the fact that it does not ever turn into a green card. So if a single person relocates on an E2 visa it’s almost impossible to ever get a green card. For married couples, if the spouse out working is unable to get green card sponsorship, then they can’t get a green card. Finally, when the children of E2 visa parents reach 21 they have to fend for themselves.

    The E2 visa is a great visa, but it can certainly be improved to address these issues. There are numerous lobby groups and reforms in the legislature who are well aware of these issues. One prominent reform proposal is for those investors who invest $200K or more. Their E2 visa could automatically turn into a green card after five years.
