E-2 Visa: Applicant’s Present Position

Select “Principal/Owner/Investor/Trader” from the dropdown. Detail your current role and duties in your home country. USCIS wants to see how your background aligns with your U.S. business. Switching fields (e.g., UK lawyer to beauty salon owner)? Your Business Plan must outline training and licensing for success.

E-2 Visa: Applicant’s U.S. Position

List your U.S. role as “Manager” and describe your executive duties, emphasizing your leadership in setting goals and driving success. Avoid appearing detached—show you’ll personally oversee the business, even with subordinate managers. Answer “No” to replacing a U.S. worker or continuing existing employment, as you’re starting or acquiring a new business.

With regards to the question as to whether this application is based on the continuance of existing employment, the answer should again be “No” since you will be leaving your home country to head up your new business.
